RESTRICTIONS ON USE OF CONDOMINIUM PROPERTY
The following restrictions shall apply to and bind the condominium, condominium property, unit, units and parcels, to wit:
SMOKING
Smoking is prohibited inside the clubhouse, (including the front entrance enclosure and the lanai to the south of the building), on the pool deck, on the shuffleboard courts, in the clubhouse parking lot, and in the 2 parking spaces to the north of the clubhouse. Smoking is also prohibited within 20 feet of any of these locations, with the exception of a clearly marked and designated “smoking allowed” area located at the east end of the storage building immediately south of the clubhouse.
(1) The Units within this Condominium are intended for housing of persons fifty-five (55) years of age or older. Except as otherwise permitted herein, all Units must be occupied by at least one person that is at least fifty-five (55) years of age (the “Qualifying Occupant”). All other occupants of a Unit must be at least forty-five (45) years of age or older, except as otherwise provided herein. The Directors reserve the right to deny the establishment of residency by spouse under fifty-five years of age, if such residency would result in less than eighty percent (80%) of the resident population of the Condominium being at least fifty-five years of age.
(2) The owners and occupants of each unit shall keep and obey all laws, ordinances, regulations, requirements and rules of all governmental bodies, divisions or subdivisions, insofar as the same pertain to the control or use of such unit and shall promptly pay each units share of the common expenses.
(3) Each resident is responsible for the maintenance of his unit, raking of grass and landscaping.
(4) Use of any facilities of Terra Cove by minors shall be governed by the rules pertaining thereto and minors must be accompanied by an adult at all times.
(5) That occupants and owners of condominium units shall not suffer, permit or maintain in or on their premises, conditions or activities which interfere with the peaceful and quiet enjoyment of the other unit owners or their units.
(6) No pets, including those belonging to visitors, shall be permitted or maintained in a unit or on the common elements.
(7) Each unit owner must keep all vehicles parked in the existing Unit’s driveway without protruding into the street. Parking on the grass/stones is prohibited at all times, and street parking will be allowed only for four hours in any twenty-four (24) hour period. A second car may be parked in the visitor parking area east of the storage area if the owner driveway does not have adequate space to accommodate it. Additional cars may be parked in the visitor parking area north of the storage area with a permit. No vehicle shall be parked in the street overnight.
(8) Motorcycles and motorized bicycles are not allowed as transportation within the park. Motorcycles and motorized bicycles will be allowed only as transportation to and from the park entrance to a resident’s home so long as the rider strictly observes noise and speed regulations in effect within the park.
Motorized vehicles, such as wheelchairs or scooters necessary for the physically handicapped, may be used for transportation on interior streets and bike paths, following approval by the Board and registration in the office.
The use of golf carts as transportation vehicles is strictly prohibited except as (1) maintenance equipment operated by park personnel or (2) for board sanctioned activities.
(9) A. No boat trailers, boats, motor homes, campers, non-motorized canoes or kayaks, or other large size equipment, or appliances, may be stored on the driveway or in the open of any unit. Lawn furniture that is being utilized by unit occupants is allowed.
B. Use of Park’s Storage Facility: Due to limited storage space, the park’s Storage Facility will be available to unit owners on a first come, first served basis. Storage space will be made available to unit owners only, on the basis of one space per unit. Per the storage lot agreement, space will be made available to unit owners only, based on one lot per owner regardless of how many units are owned. Spaces are designated for the storage of boat trailers, boats, motor homes, and storage trailers only. and non-motorized canoes or kayaks only.
C. Only items titled and registered to the unit owner are to be stored on the designated storage lot, and proof of ownership must be on file in the office. No other vehicles may be stored in this facility. No loose material or debris may be stored on the lot.
D. Non-motorized canoes and kayaks must be stored on the kayak rack for those not utilizing a storage lot or not having room on their storage lot to store their kayaks. Non-motorized canoes and kayaks may not be stored on storage lots that are otherwise empty. There is a donation for use of the kayak rack.
E. Storage lots that are not utilized for a period of twelve consecutive months will be returned for assignment to the next owner on the reservation list showing a need for a storage lot.
F. All utility trailers, boat trailers, boats, enclosed trailers, motor homes, and trailer homes must have a current title, a current registration, and a current license plate. Current title and registration must be in the storage lot file in the condominium office. These aforementioned items, where applicable, along with a current license plate, must be affixed to the trailers, boats and motor homes for those items to be considered in moveable condition.
G. All lots must be kept in a clean and presentable condition.
H. The Board of Directors shall maintain a reservations list to determine the order in which the storage spaces will be allocated. Spaces are non-transferable, and will be assigned to the next unit owner on the reservation list when any unit owner sells or transfers ownership of his or her unit. Accordingly, in the administration of the reservations program the Board of Directors will screen the applications and fill the reservation for those unit owners demonstrating a need for a storage space at the time the space becomes available. Other persons requiring storage facilities will need to find accommodations outside Terra Cove.
I. A fee schedule may be imposed and modified from time to time. The initial fee per lot will be $50 quarterly commencing on January 1, 2017.
J. No permanent structures are allowed. Utility, boat, and enclosed trailers, as well as RV’s, 5th wheels, etc., must be in and maintained in a readily moveable condition.
(10) No wires, TV antennas, air conditioners, aerials or structures of any sort shall be erected, --or maintain any exposed or outside storage or storage containers. However, exempt from this rule are those antennas, aerials, or structures allowed by the Federal Communications Commission Over-the-Air Reception Devices (“OTARD”) rule (47 C.F.R. Section 1.4000). Any antenna or aerial mounted on a mast that is not directly attached to a unit and extends beyond the roofline of the unit shall require board approval.
(11) No clothes lines, hangers or drying facilities (such as spreading over furniture) shall be permitted or maintained in public view on the driveway or grounds of any unit. Neither shall clothes, rugs, drapes, spreads or household articles or goods of any sort be dried, aired, beaten, cleaned or dusted by hanging or extending the same from any window or door of the unit. Open air clothes lines are provided (for the members use for these purposes) in a secluded area between the garage and the shuffleboard court beyond the clubhouse. If you choose not to use the drying facility provided, you must keep the drying items out of public view.
(12) No unit owner or occupant may dispose of or keep refuse, trash or garbage in or on any exterior area of the owner's unit or on the common elements, except in those receptacles approved by the Board of Directors.
A) All garbage and trash must be on curb on Tuesdays and Fridays by 9:00 a.m. Garbage must be in plastic bags and tied securely. The summer schedule may vary.
Thorn bearing growth (cactus, etc.) must be placed in puncture proof containers, boxes or cans. No garbage may be put into receptacles except Tuesday and Friday.
Cuttings, paper or dry material may be placed in the proper receptacle at any time.
B) Rocks, dirt, cement scraps, seashells, sod, etc., will not be picked up.
Tree trimmings, broken limbs, etc., must be tied in bundles of not more than four (4) feet long.
C) Large items must be placed IN dumpsters—not beside them.
D) Recyclables* will be collected on specified days ONLY.
*Recycle rules are controlled by County Government. Instructions available from Park office.
(13) No unit or its appurtenances shall be subject of a partition action in any Court of the State of Florida, and all unit owners do by their acceptance of a conveyance of such unit, waive any right to maintain or bring such action.
(14) No machine or apparatus of any sort shall be used or maintained in any unit, which causes interference with the television or radio reception in other units.
(15) No signs of any type shall be maintained, kept or permitted on any part of the common elements or in or on any unit where the same may be viewed from the common elements, except for a sign not to exceed 12 x 15 inches displayed in the window of a mobile home identifying it for sale. *Units situated on corner lots may display 2 such signs, one visible from each street.
(16) No garage, patio or rummage sales are permitted on unit property.
(17) Each unit owner, lessee or occupant shall maintain at all times in good condition and repair, subject to regulations by the Corporation, the mobile home and other improvements located on the unit. In the case of negligence in the care and upkeep of the mobile home and the landscaping, the Board may give fifteen day written notice to the resident specifying the repairs or maintenance needs and if the same are not made within fourteen days after the receipt of the notice, the Board may perform the repairs or maintenance and assess the resident for the cost of such repairs or maintenance.
(18) All accessory buildings and/or modifications of mobile homes (including driveway and siding texture and color) subsequent to the recording of the Declaration must receive prior written approval of the Board of Directors. It is the owner's responsibility to obtain the necessary permits from the County and see that they are posted on the premises. No structure or building shall exceed the height of the side eave lines of the mobile home
(19) No additional utility sheds or exterior cabinets are permitted.
(20) Decorative cement blocks are preferred for skirting of mobile homes and screening of blocks from the bottom of the Unit to the ground is required. Mailboxes and posts must conform to existing units. Awnings must be a minimum of six (6) feet three (3) inches from ground, to avoid injury to workers.
(21) Lawn furniture and hoses shall be placed on the unit so as not to interfere with the use of riding lawn mowers.
(22) No trees or shrubbery may be removed or planted without the prior written approval of the Board.
(23) Compressors for central air conditioners shall be installed in accordance with appropriate governmental ordinances. No window-type air conditioning units are permitted.
(24) No boat dock or docks shall be erected except with the express written permission of the Sarasota County Government and the Board of Directors.
(25) The occupants of units shall abide by all the Uniform Rules and Regulations promulgated by the Corporation concerning occupancy and use of the condominium units and common elements and areas, which rules and regulations shall not discriminate against any unit owner or class of unit owners.
(26) No mobile home may be permanently occupied by more than four persons if it contains two bedrooms nor more than two persons if it contains one bedroom. “Permanently” means more than thirty (30) consecutive or non-consecutive days in a twelve (12) month period.
(27) ALL guests, whether using common facilities or not, must be registered in the Park office. For visitor automobiles, limited parking space is available in the visitor parking area east of the storage area. in the visitor parking area north of the storage area with permit. Requests for guests to park a boat, trailer or RV in this area will be subject to availability of space and Board approval. All vehicles using this space must be registered in the office and tagged with host’s house number.
. (28) A - The homeowner’s guests who are immediate family members of the owner, including parents, siblings, children and grandchildren, may visit four weeks during each calendar year.
B - Any of the forenamed family members who are age fifty-five (55) or older may extend their stay, whether or not the homeowner is present, providing the Board is duly notified by the homeowner.
C - other family members or guests may visit four weeks when the homeowner is present, but visits will be limited to twenty (20) days when the homeowner is not present. Reasonable exceptions to the foregoing rule may be authorized by the Board of Directors for bona fide caregivers of homeowners.
(29) No rental will be permitted for less than 3 months or longer than 6 months in the period running from July 1stof one year to June 30th of the following year to any one tenant or group. Multiple tenant groups are not permitted within the period. There will be a charge of $25.00 for registration and administrative work for first time renters.
(30) Prospective subtenants of a mobile home must be acceptable to and approved in writing by the Board and must execute a signed copy of the Rules and Regulations that are then in effect. Each resident shall be responsible for all violations of those Rules and Regulations by his, her or their subtenant as though such violation were committed directly by that resident: The Association shall direct its notices, complaints and other communications to resident and the subtenant.
(31) There will be a $200 fee for Change of Ownership/Estoppel Fee.
(32) The monthly maintenance fee is due the first (1) of each month. A late charge of $5.00 will be assessed for those payments received after the fifth (5) day of the month. Make all checks payable to: TERRA COVE HOMEOWNERS CORP., INC.
(32) (A) The office MUST be notified when anyone is occupying a unit.
(33) No resident should purchase a mobile home to be placed on a Park space without prior written approval from the Board. Homes must meet all Park specifications, and government regulations. Board approval will not be given unless the mobile home meets the following requirements;
A. It must be in excellent condition and match the aesthetics at the time it is to be moved into the Park.
B. It must have been constructed by a recognized mobile home manufacturer, in compliance with a mobile home building code, which included specifications for electric, plumbing and heating installation.
C. It must have a minimum of 24 feet in width and 40 feet in length and match the footprint of the unit being replaced.
(34) Watering of lawns must conform to Sarasota County regulation and restrictions.
(35) No fences or walls of any type are permitted in the Park.
(36) The throwing or placing of garbage, refuse, trash or any other matter into the canals, lakes, or waterways within or abutting the Park is strictly prohibited.
(37) No commercial solicitation is permitted in the Park. other solicitations are permitted only with prior written approval from the Board.
(38) No resident may engage in commercial business in the Park. Neither may residents advertise their private business on Association property.
(39) Outside lights shall be of a type installed so that they are not objectionable to neighboring residents and/or traffic.
(40) The speed limit on all streets and roadways in the Park shall be a maximum of fifteen (15) miles per hour unless posted.
(41) A resident may make minor vehicle repairs in a timely manner on his/her or their driveway as long as the area in which those repairs are made is kept in a neat, clean and orderly condition at all times. Engine overhaul, transmission overhaul, rear axle overhaul, or any form of body repair cannot be performed in the park.
(43) All recreational facilities are used by residents and guests at their own risk.
(44) All private parties or other prearranged functions to be held in the Clubhouse must be scheduled through the Board of Directors.
(45) After the Clubhouse facilities have been used for private functions, they must be left in clean and orderly condition or a charge (in an amount determined by the Board) will be assessed against the sponsoring party for the costs of cleaning the area.
(46) At no time will the Clubhouse be closed to any resident as a result of any private function.
(47) Chairs must not be removed from the pool area.
(48) No Beach or swimming attire will be permitted in the Clubhouse except in restroom areas.
(49) No food or drink is permitted on the pool deck, and no drinks are permitted on the pool rim when swimming. However, food and drink is permitted at the tables located under the metal awning that separates the pool from the shuffleboard courts. No glass containers of any kind permitted in pool enclosure.
(50) Place towel or other covering on chairs & lounges when wearing proper swim attire.
(51) No floats, air mattresses, inner tubes, or plastic bottles are permitted in the pool. After use, noodles must be removed and return to proper storage area. Safety buoys must be kept secured in place at all times.
(52) No shorts or cut-offs in pool.
(53) Towel dry before entering restrooms.
(54) Showering to remove suntan lotion is recommended before entering the pool.
(55) Soap, shampoo or any cleaning agent not permitted in pool area or pool shower.
(56) Minor children must be accompanied by adult while using the pool.
(57) Residents shall not request help from Park employees for personal matters.
(58). Any resident soliciting a bid from and/or permitting a contractor to begin work at his, her or their mobile home will be responsible for ensuring that such contractor has the proper license and insurance. Residents who perform home maintenance jobs, yard work, painting, and similar tasks for neighbors in Terra Cove are not required to be licensed and insured. However, it is the responsibility of the individual homeowner to assure that their liability insurance policy provides sufficient coverage should an accident occur. Contractors working on condominium property must follow all rules and regulations of the park, including but not limited to no trailers stored on driveways.
(59) The violation of any federal or state law or local ordinance within the Park is a violation of these Rules and Regulations.
(60) The Board of Directors will give full consideration to valid complaints submitted in writing and properly signed, or to telephone messages, which include complainants name and address. Anonymous calls and letters will be dismissed without discussion.
USE OF AMENITIES
(61) Use of any park amenities, including the pool, pool area, shuffleboard court, parking spaces, hobby shop, tools or implements, refuse dumpsters and boat launch are for the use and enjoyment of the persons currently occupying the unit. Resident/owners and others cannot use the amenities while living outside the park when their unit in Terra Cove is occupied. Use of the hobby shop and refuse containers for projects outside the park is strictly prohibited.
